1. About these Terms
These Creator Terms ("Creator Terms") are an agreement between you and TRIPSORA CAPITALS LTD ("we", "us", "our"). They apply when you apply for or use a creator account on https://www.trip-planner.ai (the "Creator Program"). They add to our Terms of Service, Privacy Policy, Cookie Policy and Website Disclaimer and Affiliate Disclosure. If they conflict on a creator matter, these Creator Terms win.
You must be at least 18. You may apply as an individual or for a business; if you apply for a business, you confirm you can bind it. Words used here that are defined in the Terms of Service (for example "Service", "AI-Generated Content" and "Partner") have the same meaning.
In these Creator Terms: "Trip" means an itinerary, with its text, photos, links and embedded clips, that you publish on the Creator Program. "Your Content" means everything you submit, including your profile, Trips and any text you paste into our tools.
In short: you publish free Trips for readers. We do not sell your Trips, take payments for you, or pay you a share of sales or commissions. You may link to a tips page or to a full guide that you sell yourself on another site; those are your own dealings with your fans.
2. Your creator account
Approval. Every application is reviewed. We may approve or reject an application, and may ask for more information. We do not have to give a reason.
Your details. Give true and current information. Choose a handle (the part after "@" in your page address) that does not impersonate anyone and does not infringe anyone's rights. You cannot change your handle yourself after sign-up; ask us if you need a change.
Security. You are responsible for activity on your account. Keep your password and sign-in links private and tell us at once if you think someone else has access.
One account. Do not create more than one account to get around a limit, a suspension or a rejection.
3. Your content and our licence
You keep ownership of Your Content.
Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, format, display, publish and distribute Your Content on our websites, in our emails, on social media and in search results, and to promote the Creator Program and your Trips (for example by featuring them on our pages and posts). This includes using your Trips as the starting point for AI-generated "remix" plans for readers (section 8), and sharing Your Content with the service providers that run the Creator Program for us, such as hosting and AI providers.
Remixes. A reader's remixed plan is a new plan generated for that reader. It may keep some of your picks and wording. The reader may use it for their own travel planning; they get no rights to republish your Trip.
How long the licence lasts. It lasts while your Trip is published and for a reasonable period afterwards to remove it from caches, backups and search results (up to 30 days). It continues for remixes and shared plans created before you removed the Trip, for the reader's personal use, and for copies kept for legal and dispute purposes.
Your promises. You promise that: you own Your Content or have every right and permission needed to give us this licence (including for photos, music, videos, text and any people shown); Your Content does not infringe anyone's copyright, trade mark, privacy or other rights; and any clip you embed from Instagram, TikTok, YouTube or X is yours or you have the right to embed it, and you accept that those services' own terms apply to the clips. Do not submit anyone else's personal data (for example photos of identifiable people or their contact details) without their permission.
Credit. We show your name, handle and photo with your Trips. You may not claim that we or any Partner endorse you or your Trips.
4. Content rules
All of the Prohibited activities in section 7 of the Terms of Service apply to you. In addition, Your Content must:
be honest. Describe places and experiences truthfully; do not invent visits, reviews, awards or prices; and take reasonable care that facts such as opening times, prices and entry rules are right when you publish. Update or unpublish a Trip that you learn is out of date or wrong;
not be unlawful, hateful, harassing, sexually explicit, defamatory or misleading, and not encourage dangerous or illegal activity (for example trespassing, drug use or unsafe animal encounters);
not contain fake or incentivised reviews, hidden advertising, spam, malware, or links to sites we have not approved;
not copy another creator's Trip or text. Draw on your own experience.
AI tools (ours or anyone else's) can write inaccurate text. If you use them, you must read, check and correct the result: you are responsible for everything you publish.
5. Advertising, sponsorship and affiliate links
The law. You must follow the UK advertising and consumer rules that apply to you, including the CAP Code, the Advertising Standards Authority (ASA) and Competition and Markets Authority (CMA) guidance on influencer marketing, and the Digital Markets, Competition and Consumers Act 2024. If you are in another country, you must also follow its rules.
Tell people when something is an ad. If a hotel, tour operator, tourist board or anyone else has paid you, given you free or discounted services or products, or otherwise has a commercial relationship with you about something in a Trip, you must say so clearly and prominently in the Trip text (for example "Ad – gifted stay") and in any video you embed. If you are not sure whether something needs a label, label it.
Our affiliate links. Each Creator Program page carries a notice that Trip-Planner or the creator may earn a commission from links on the page. Hotel, tour and activity links on your page are created by us from the name you enter, using our own partner accounts. You may not add your own affiliate or tracking links, referral codes, discount codes or paid placements anywhere in your profile or Trips. Links on a stop are limited to maps and reference sites that we allow.
You earn nothing from partner bookings. We earn commission from our Partners when readers book through links we create. You do not receive any share of those commissions, and a booking made by a reader does not entitle you to a payment.
6. Tips, guides and payments
No payments through us. We do not sell Trips, collect money for you, or pay you a share of anything (sales, commissions or question packs). Trips on the Creator Program are free for readers.
One tips link. You may add one "tips" link to your profile. It must go to a site we have approved (currently Ko-fi, Buy Me a Coffee and Patreon). Fans who use it deal with you and that site, not with us.
One full-guide link per Trip. If you sell a longer or more detailed version of a Trip, you may add one link to it on a site we have approved (currently Gumroad and Lemon Squeezy). We show it with a notice that the guide is sold by you on that site and that we are not the seller and not a party to the sale. Do not describe the free Trip as incomplete or misleading to push sales, and say clearly what the full guide adds.
Your own dealings. You are the seller of your guides and the recipient of any tips. You are responsible for your own prices, refunds, customer service, consumer-law information, VAT and other tax, and for the terms and fees of the site you use. We are not responsible for those sites, their payments or what you sell, and we have no liability to your buyers or supporters.
Approved sites only. We may add or remove approved sites and may remove a link that breaks these Creator Terms, misleads readers, goes to a site that has stopped working, or creates a legal risk. You may not put referral, affiliate or discount codes in these links.
Commissioned Trips. We may occasionally ask a creator to write a Trip for a fixed fee. That is a separate written agreement that sets the Trip, the fee, the rights we get and when we pay. Nothing in these Creator Terms promises payment or work.
Tax. You are responsible for any tax on what you earn from tips, guides or commissioned work. We may ask for information to pay a commissioned fee and to meet our legal duties.
7. Statistics
We may show you totals for your page and Trips, such as views, remixes and clicks on links. We do not give you readers' personal data. You must not use bots, incentives or misleading posts to inflate numbers, and must not try to identify individual readers.
8. AI features
AI import. If you paste notes into the editor, we send the text to our AI providers (currently Groq and Google Gemini through our own servers) to turn it into a draft itinerary. Do not paste passwords, payment details or other people's private information. We do not keep the text you paste; we keep a record that you used the feature. The result is a draft that you must check and edit before you publish.
Remix. Readers can ask our AI to adapt your Trip to their own dates, budget and interests. The result may differ from your Trip and may contain mistakes. We try to keep your key picks where they fit and to credit you, but we do not guarantee how a remix looks.
Our general terms on AI-Generated Content (section 12 of the Terms of Service) apply.
9. Our rights to moderate and change things
We can review, edit for format, reject, hide, unpublish or remove any Trip or profile, and suspend or end an account, if we reasonably believe it breaks these Creator Terms or the law, is inaccurate or unsafe, harms our Partners or readers, or damages our reputation. Where we can, we tell you why and give you a chance to fix it, but we may act at once for serious or illegal content.
We may change the Creator Program, its features and the list of approved sites at any time. We give at least 30 days' notice by e-mail of changes that materially reduce what the program offers you.
10. Personal data
How we use your personal data, and readers' data, is explained in our Privacy Policy. Your name, handle, photo, bio, country, social links and any tips link are public on your page. We are the controller of readers' data. You must follow data protection law for anything you collect yourself, for example through your videos or your own store.
11. Liability
Nothing in these Creator Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
The Creator Program is provided "as is". We do not promise any level of traffic, tips, sales or earnings. We are not liable for lost profits, lost earnings or indirect losses. Subject to the first point, our total liability to you in connection with these Creator Terms is limited to the fees we paid you for commissioned Trips in the previous 12 months, or £100 if none.
You are responsible for Your Content and for your own tips and guide sales. You will compensate us for losses, claims and reasonable legal costs that arise from Your Content or your sales breaching these Creator Terms or someone else's rights.
12. Ending the relationship
You can close your account at any time by e-mailing us. Your Trips are then unpublished within 30 days, subject to section 3.
We can end your account on 30 days' notice, or immediately if you seriously or repeatedly break these Creator Terms, put readers or Partners at risk, or we are required to by law.
When an account ends, we pay any fee already agreed and earned under a commissioned-Trip agreement. Sections that by their nature should continue (for example 3, 5, 6, 11 and 13) continue after the end.
13. General
Changes to these Creator Terms. We may update them. We tell you by e-mail at least 30 days before material changes take effect; if you keep using your account after that date, you accept them.
Law. These Creator Terms are governed by the laws of England and Wales and disputes go to the courts of England and Wales (consumers may also use the courts of their own country). We encourage you to contact us first.
Notices. We contact you at the e-mail on your account. You contact us at [email protected] (complaints: "Formal Complaint" in the subject, as described in our Terms of Service).
Whole agreement; severability; no waiver. These Creator Terms with the documents above are the whole agreement about the Creator Program. If part of them is not enforceable, the rest still applies. If we do not enforce a right straight away, we do not lose it.
Assignment. You may not transfer your account or these Creator Terms to someone else. We may transfer them to a company that takes over our business.
